  1. Welcome! And thank you for accessing the ntel website. These terms and conditions (“Terms”) apply to your use of our website or any part of it (“the Site”). Some portions of the site or some of its services may have other terms, which we will make available when applicable. ntel may from time to time modify these Terms. You are therefore advised to keep up to date with any changes by regularly reviewing the Terms.
  2. By using, accessing, browsing, framing and/or linking to this site you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
  3. Some pages are only available if you register first but you do not have to register to access most of the pages on the Site. If you do register, we may ask you to provide personal details such as name, address, e-mail address, telephone number and ntel account number where appropriate.
  4. In such a case, you are responsible for the proper use and security of any passwords. ntel does not guarantee the security of the Site against unauthorised or unlawful access or use.
  5. ntel may delete a registration (and any associated information or data) without notice if it has not been used for more than six (6) months or at any time if in its absolute discretion it considers that you have abused the use of the site or are in breach of these terms in any way.
  6. It is technically impracticable to provide a fault-free site and ntel does not undertake to do so. In the event of a fault, ntel will take steps to restore the Site as soon as is reasonably practicable.
  7. Access to the Site may occasionally be suspended or restricted for operational reasons such as maintenance or the introduction of new facilities or products.
  8. ntel reserves the right at any time, and without notice, modify, edit, delete, suspend, discontinue, temporarily or permanently, any content, including any products available through the Site or any part of it.
  9. Content provided by ntel including information, data, material, text, designs, graphics, pictures, video, photographs, applications, software, audio and other files, and their selection and presentation, are owned by ntel or licensed to ntel by third- parties. It is protected by copyright, trademark and other intellectual property rights as applicable and provided solely for your own use. Republication or redistribution of content, including by framing or similar means, is prohibited.
  10. You must not permit or make any attempt to disassemble, deconstruct, break down, hack or otherwise interfere with the Site.
  11. You may not use the content or services we make available here in ways that might violate our intellectual property rights, harm our systems, or abuse other users of the site.
  12. You will indemnify, keep harmless and defend ntel against any claims, losses, costs and liabilities arising from any claims by you or any third party, in connection with the use or misuse of the Site.
  13. All the materials on the Site are provided “as is”, without any conditions, warranties or other terms of any kind. Unless otherwise expressly specified, ntel excludes all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law relating to satisfactory quality, and fitness for purpose) which, but for this clause, might have effect in relation to the Site.
  14. ntel is not liable whether in contract, tort, under statute, for misrepresentation or otherwise (including in each case negligence) and whether or not the party concerned was advised in advance of the possibility of such loss or damage, whether direct, indirect or consequential howsoever arising under or loss of profit, loss of revenue, loss of anticipated savings, loss of opportunity, loss of business, wasted expenditure, loss from business interruption, loss or corruption or destruction of data, loss of contracts, loss from expenditure of time by managers and employees, liability to third parties, pecuniary losses arising from goodwill, or loss of or damage to goodwill; or any indirect or consequential loss or damage whatsoever, resulting from your use of or inability to use the Site, or from your relying on the accuracy or completeness of the Site content.
  15. You may not transfer any of your rights or obligations under the Terms to another party.
  16. The delay of ntel to exercise any of its rights or act upon a breach of these terms shall not be deemed a waiver of any subsequent breach of the same or any other term or provision of these Terms and Conditions.
  17. We will not be liable to you for any matter or circumstances beyond ntel’s reasonable control.
  18. ntel will not disclose any information of a confidential nature obtained as a result of the use of the Site to any person other than employees or officers of its affiliated company, professional advisers and suppliers. Information of a confidential nature excludes:
(a) Any information which became available to the public other than through a breach of the Terms;
(b) Information lawfully in the possession of the recipient before the disclosure took place;
(c) Information for which disclosure is required by law, by an order of court or by any government authority.
  19. Under no circumstance shall ntel be liable to you whether based on contract, tort (including negligence or breach of statutory duty) or otherwise for loss (whether direct or indirect) of profits, opportunity, business, or anticipated savings or for any indirect or consequential loss whatever resulting from your access to, use of, or inability to use the Site and the content, whether based on warranty, contract, tort, negligence or any other legal theory, and whether or not we know of the possibility of such damage.
  20. ntel will comply with its obligations under applicable data protection legislation and maintain all relevant registrations and notifications for the purposes of operating the Site.
  21. You shall take all reasonable steps to ensure that all software used with or in connection with the Site are free from viruses or any other harmful components.
  22. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of the remaining provisions of these Terms.
  23. These Terms and Conditions shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria.
  24. Any disputes arising out of the use of this Site shall be submitted to Arbitration in accordance with the provisions of the Arbitration and Conciliation Act, Cap A18, Laws of the Federation of Nigeria, 2004 or any amendments or re-enactments thereof utilising the rules contained in the said Arbitration and Conciliation Act. The arbitration venue shall be Lagos, Nigeria.
  25. The Parties agree that any action related to these terms and conditions shall be subject to the jurisdiction of the Nigerian courts.

 

 

 

Data Test Drive

The Data Test Drive (DTD) is subject to the following terms and conditions, in addition to our General Terms and Conditions (Click here to read)

  1. The DTD is an advanced data management technology which allows us offer our customers unlimited use of data services.
  2. Every new ntel subscriber can get the DTD by activating a SIM, subscribing to a data bundle and keeping that data bundle active for 90 consecutive days (the Test Period).
  3. Use as much data as you want within the Test Period and you won’t have to pay a thing, even if you go over your bundle data allowance.
  4. This offer is only available upon first activation and will last for 90 consecutive days from activation.
  5. You must have a 4G LTE compatible and enabled device to enjoy the DTD.
  6. To qualify, the chosen data bundle must be kept active for the entire Test Period.
  7. You can get the DTD with any new or upgraded bundle that is:
  • A daily data plan
  • A weekly data plan
  • A monthly data plan
  • A quarterly data plan
  1. There will be no cap on data usage during the Test Period as long as bundle subscription is active.
  2. Each bundle subscription shall be automatically renewed at the end of each Test Period if there is sufficient unutilized pre-payment to cover such renewal.
  3. The DTD may not be combined with other offers.
  4. The DTD works only in Nigeria. If you go abroad during your Test Period we will charge you standard roaming rates while you are there and your Test Period will continue to run in your absence.
  5. ntel will monitor your data use. Towards the end of the DTD we’ll send you a notification summarizing your rate of data consumption so that you can decide which of our bundles will best suit your needs.
  6. The DTD shall be on a ‘per SIM/per bundle’ basis; and where a group activation has been made, each SIM/bundle subscribed to must be on a different device and the group must subscribe to a uniform bundle.
  7. In the event where bundle subscription of one SIM lapses and is not renewed, the other subscriptions will be automatically suspended from the DTD.
  8. Our fair usage policy is applicable to the DTD. Follow this link to read our fair usage policy.
  9. The DTD does not apply to any bundle offerings where data is not included.
  10. If you move from one data bundle to a different data bundle during the DTD, the Test Period will not restart on new bundle. So, you may only get what is remaining of your original Test Period.
  11. Note that if you exceed your data allowance after the Test Period has elapsed, our standard data charges will apply. If you wish to change your data bundle, just contact us at any of our listed outlets or offices.
  12. You can revert to your original bundle and remove any additional data from your bundle at any time by contacting us; and your data allowance and charges will revert to the original amount in your bundle (including standard data charges for additional data use).
  13. Integration of email accounts is subject to your email service provider and IT infrastructure. ntel will not be liable if you are unable to integrate your email. Please check with your email service and IT infrastructure provider(s).
  14. Integration of email accounts on your devices is limited to a maximum of 10 and subject to your device capability.
  15. ntel will not be liable for any unauthorized access to information stored on your device, nor for any loss suffered due to the use or otherwise of this service.
  16. Where the information supplied during registration is deemed insufficient or where there is any discrepancy, ntel reserves the right to change or stop your service.
  17. The DTD will be available for a limited time and we reserve the right to add to, substitute or discontinue the DTD at any time.
  18. We reserve the right to monitor your usage and if we reasonably determine that your use is abusive or in breach of our fair usage policy, we may do any or all of the following: (i) request you to moderate your use; (ii) impose further charges in respect of your atypical or abusive use; or (iii) suspend or withdraw your access to the DTD. However, this will not affect your standard voice and text usage.
  19. After the DTD has ended, no new DTD activations will be allowed.
  20. You may terminate your participation in the DTD at any time during the Test Period but all bundle payments are non-refundable.
  21. Notices will be sent either by SMS or via email, if an email address is provided.
  22. We reserve the right to change these terms and conditions at any time.

 

 

Number Reservation

The Number Reservation process is subject to the following terms and conditions, in addition to our General Terms and Conditions (Click here to read)

 

  1. All reservations must be made online between the ____day of March 2016 (the ‘Opening Date’) and 12 midnight on the 31st of May (the ‘Closing Date’).

 

  1. The reservation window can be closed by ntel at any time without recourse to the customer.

 

  1. Only numbers that are deemed available by ntel may be reserved. Certain number sequences may not be available.

 

  1. Upon reservation, you will have ninety (90) days to activate the number(s).

 

  1. ntel shall notify you when the activation period will commence.

 

  1. To activate the number(s), you will be required to visit an ntel shop or distributor outlet to physically pick up a SIM after completing the regulatory SIM registration process (KYC). Following which activation can be done by loading airtime or purchasing a data bundle (see our activation procedure here)

 

  1. You must ensure that the details provided by you at the time of number reservation or any other time are correct and complete.

 

  1. You must not register someone else’s information on ntel’s website without their permission.

 

  1. Reserved numbers can only be SIM-activated at ntel shops or distributor outlets after you have completed the mandatory KYC and airtime recharge (activation).

 

  1. You will be notified by email confirmation of your reservation. Without this email you will be unable to SIM-activate the reserved number(s).

 

  1. Each customer is allowed to reserve a maximum of 5 numbers.

 

  1. In order to SIM-activate a reserved number, customers must visit an ntel store, distributor outlet or a sales agent with the following:

 

  • A print-out slip of the reservation confirmation mail;
  • Any form of valid government-issued identity card.

 

  1. The registered owner must be the person in whose name the number was reserved. Reserved numbers are not transferable between customers.

 

  1. ntel reserves the right to not approve any reserved number request based on its sole discretion.

 

  1. ntel reserves the right to cancel any number reservation at any time.

 

  1. ntel accepts no responsibility whatsoever for any loss, direct, indirect or consequential, arising from any reservation made and actions resulting therefrom.

 

  1. In the event of any discrepancy between registered information and personal identification document provided at the time of activation, ntel reserves the right to decline activation of the reserved number(s).

 

  1. ntel has the right to withhold, modify, cancel or deactivate your service and/or take corrective action for any reason at its sole discretion including, but not limited to, your violation of these terms and conditions or ntel’s Fair Use Policy (Click here to read).

 

  1. Ntel may change or withdraw any number without prior notice to the customer and without being liable to the customer in damages or otherwise.

 

  1. You hereby agree to indemnify and hold ntel harmless against any expenses, loss, harm or other damages brought against or sustained by ntel which arises directly or indirectly from your use of the service.

 

  1. You shall comply with all instructions issued by ntel which concern your use of the service.

 

  1. You shall provide ntel with all such necessary information which ntel may, in its sole discretion, reasonably and lawfully require.

 

Early User Trial (ntel Pioneers)

The following terms and conditions shall be read in conjunction with other Terms and Conditions published on the ntel website or included in any other communication to you.

  1. By collecting your SIM and activating it during the bundle pre-order period, you demonstrate confirmation of your participation in this Pioneer User Trial and acceptance of these Terms and Conditions.
  2. While your pre-ordered bundle will be activated from May 1st, 2016; you will, in the interim, be able enjoy free unlimited data and SMS to other users on the ntel network. Refer to our Fair Use Policy.
  3. You will require a 4G/LTE-Advanced compatible device to be able to enjoy services on our network.
  4. ntel reserves the right to activate your pre-ordered bundle on or after May 1st, 2016 without any further notification to you.
  1. You agree to participate in this trial “as is” and ntel makes no express or implied warranty of any kind with respect to the fitness for any particular purpose or use; the design, condition, quality and the performance of the trial.
  2. ntel and its employees, officers, agents and contractors hereby exclude all liability for any loss or damage (including without limitation, indirect, special or consequential loss or damage) arising from the use of, or reliance upon the trial whether or not this is caused by a negligent act or omission.   3. You are only entitled to use our trial for personal, non-commercial use. We reserve the right to impose network protection controls, limit the speed of, suspend or block your access to services, if, in our reasonable opinion, you are abusing the services in any way or using same for any illegal purpose.

 

SAT-3

This offer is subject to the following terms and conditions:

  1. MRC and NRC for destination aside ntel POPs are available on request.
  1. Charges may be paid in the currency of the order or in Nigerian Naira, at the prevailing interbank exchange rate, to the account of NATCOM DEVELOMENT AND INVESTMENT LIMITED provided in the relevant invoice.
  1. All prices exclude applicable taxes such as VAT and are payable in advance without any set-off in line with the relevant agreement between the Parties.
  1. Prices are fixed for a minimum term of one year, or more, as may be agreed by the Parties; from the date of commissioning of the circuit.
  1. Customers shall pay, along with the Non-Recurrent Charges, a deposit equivalent to one month’s charges prior to the commencement of the service and such deposit shall be applied against the last month’s service.
  1. Prices in this offer are valid for 30 days.
  1. Delivery will be made within 3-6 weeks after Contract and order signature and receipt of NRC, deposit and first monthly payment. Delivery time which may be earlier or later for bespoke solutions shall be as agreed by the Parties.

 

Mobile Services

1.    Definitions:

1.1    “Access” means the number of days that a Subscriber shall be entitled to use the network as determined by the recharge or bundle purchased by the Subscriber from time to time, subject to Clause 2;

1.2    “Account” any account created by user on our self-help portal.

1.3    “Activation” means the enabling of a duly registered ntel sim on a device so that such device operates on the network in terms of this T&C’s;

1.4    “Automatic Renewal” or “Auto-Renewal” refers to the automatic renewal of recurring subscriptions or bundles offered by ntel;

1.5    “Airtime” means the credit obtained from entering or loading the value of the amount paid onto your device (a recharge event);

1.6    “Bundle” means the pre-paid rate plan which a subscriber chooses that contains service allotments for minutes, messages and/or data;

1.7    “Electronic PINs (E-Pins)” means airtime generated electronically and conveyed via a unique number of digits, which when validly activated on the NatCom network, will transfer a pre-determined credit value on the ntel network to a Customer’s account;

1.8    “Load” means to enter the E-Pin value onto a device to recharge an activated subscriber’s access on the NatCom network so that the subscribers account is credited with the quantum of airtime duly purchased;

1.9    “ntel” means NatCom Development & Investment Ltd, a company incorporated in accordance with the   laws of the Federal Republic of Nigeria. ntel or NatCom may be used interchangeably in this T& C’s.

1.10    “Network” means the 4G Long Term Evolution (LTE) Advanced network operated by NatCom by which the network services are made available by ntel to the subscribers.

1.11    “Network Services” means those 4G LTE telecommunication services made available from time to time by ntel via the network;

1.12    “Electronic Airtime card” means a naira denominated voucher purchased by a subscriber and which allows a subscriber usage of the network services to the value indicated thereon;

1.13     “PAYG or Pay-As-You-Go” means the pre-paid rate plan in which the purchased airtime is used to pay for services at the time the service is accessed or consumed. If there is no available Airtime, then access to the requested service will be unavailable

1.14    “Revenue Generating Event” means income generated from purchase and use of ntel’s products and services by subscribers.
 
1.15    “Roaming” means using your SIM card to connect to another network whilst you are outside Nigeria.
 
1.16    “Subscriber” means individuals or corporations who contract to use and pay for ntel’s products and services.

1.17    “Terminal equipment or device” means a 4G, LTE Advanced compatible terminal or device and accessories thereto which are used by the Subscriber to make and/ or receive calls or message via the Network (which may be commonly referred to as a Phone, Router or MiFi) or a device which is used to access the internet through a data subscription.

2.    Access:

2.1    Unless otherwise advised by NatCom, the Electronic Airtime allows you to access the Network services within the area designated by the card in the Federal Republic of Nigeria only.

2.2    Access is subject to the following:

a.    a maximum of 365 days’ network access from activation, and this is renewed every time you Perform a Revenue-Generating Event, including but not limited to the following: Recharge of Account, Purchase of Service Bundle, Pay-As-You-Go Usage, Receipt of Incoming voice calls or SMS, as well as purchase and Auto-Renewal of various subscription-based services offered by ntel.

b.    a Service expiry occurs if any of these three conditions are met: (i) if you do not charge your account or perform any Revenue-Generating Event 365 days after service was activated, or (ii) if you did not charge your account or perform any revenue-generating event for 365 uninterrupted days, or (iii) if the validity period for the bundle you purchased has Lapsed in accordance with stipulated timelines for expiry.

3.    Calls

3.1    When you receive a call on your terminal equipment, the cost of such call shall be for the callers account and charged at the applicable bundle or PAYG rate.

3.2    Airtime usage is measured from the time the network begins to process a call (before the phone rings or the call is answered) through its termination of the call (after you hang up)

3.3    ntel shall be entitled to immediately suspend any calls and/or other network services if:

a.    the Airtime/credit has been used up or has been forfeited for any reason;

b.    the account has reached the threshold set by ntel as your credit limit or bundle validity period;

c.    the account has not been paid within the stipulated period required by ntel.

3.4    You can only use your ntel subscription to make and receive calls, send and receive messages, or access ntel data services in areas covered by the ntel network, within the Federal Republic of Nigeria, or within locations across the world where ntel has established partnerships with other Mobile Network Operators, for roaming purposes.

4.    Terminal Equipment (Device) and Electronic Airtime

4.1    Risk attached to products including sim airtime and Terminal equipment shall transfer upon delivery of same to you and accordingly ntel accepts no responsibility whatsoever for any loss or damage to any of the products or services including inter alia, the electronic airtime card where applicable. In the event of you losing your terminal equipment or refill voucher/card, such items shall be replaced at your own cost.

4.2    ntel will not be liable for any loss or damage of whatever nature arising from/ caused by the loss, unauthorized distribution and/or manufacture of any refill voucher/card.

4.3    ntel is under no obligation to give you any proof of how your airtime has been used or of any calls made or received on your terminal equipment. Accordingly, ntel is under no obligation to give itemized information with respect to any call records for your Terminal Equipment or Phone number.

4.4    You will be charged for text, instant or picture messages, and email whether read or unread, sent or received, solicited or unsolicited.

4.5    if you lose any terminal equipment purchased directly from ntel you should report this to ntel immediately.

4.6    in the event of loss of a damage to your terminal equipment you have a choice of either purchasing a replacement terminal equipment with a new number or retaining the old number. The replacement or exchange of terminal equipment, as the case maybe, will still be charged for at a rate determined by ntel in accordance with any relevant requirements.

4.7    you may not in any way tamper with, modify or decompile your sim or and terminal equipment. In the event that ntel has reason to believe that you have so tampered with your terminal equipment, ntel reserves the right to suspend your network services.

4.8    In purchasing terminal equipment from ntel:

a.    you acknowledge that ntel shall not be liable for any loss, injury or damage to any person arising out of the use of your terminal equipment.

b.    you indemnify ntel and hold it harmless from and against any liability arising out of claims made against ntel, its employees and/or its agents in connection with the use of the terminal equipment.

4.9    You will be liable for all charges that are, or payable in respect of each terminal equipment issued to you whether you or any third party used such terminal equipment.

4.10    Nothing contained in these terms and conditions pertaining to the sale of sim or and terminal equipment will be constructed as vesting in or transferring to you any right, title or interest in the software, the phone number or any intellectual property belonging to ntel.
    
5.    Indemnity and warranty

5.1    Furthermore, you acknowledge that ntel shall not be liable for any loss, claim, harm, expense or damages, suffered or sustained by you or any third party and arising, directly or indirectly out of suspension of the Network services or any of them pursuant to the provisions of these conditions.

5.2    without detracting from any of the other provisions of these terms and conditions, ntel shall not be liable to you for any loss or damage suffered by you and whether same is direct or consequential, in the event that such loss or damage was caused by any negligent act or omission on the part of ntel, its employees and/ or its agents.

5.3    no warranties, whether implied or express are given in relation to the network. The sole warranty given in respect of the terminal equipment’s is contained in the warranty certificates.

5.4    The limitations in this section also apply to any claims you may bring against any other party to the extent that ntel would be required to indemnify that party for such claim. You agree ntel is not liable for problems caused by you or a third party, or by any act of God. You also agree that ntel is not liable for missed calls, deleted voice mails, other messages or any other information (like pictures) that gets lost or deleted from your Device, or for failure or delay in connecting a call or text to any other emergency service.

6.    Conforming with the Law and Dispute Resolution

6.1    You are entitled to refer any dispute relating to the network services to any telecommunications representative who may be appointed as such by the Nigerian Communications Commission. Except to the extent prohibited by law, all claims must be brought within 2 years of the date the claim arises.

6.2    by these terms and conditions, ntel is hereby authorized upon demand, to disclose to any statutory or duly authorized bodies, persons and without notice to you, any private or confidential information which it may be in possession of in the course of your enjoyment and use of the telephone or other related services, in accordance with any law or regulation in force in Nigeria at any point in time. The terms and conditions shall apply to all subscribers.

6.3    You and ntel each agree that any proceedings, will be conducted only on an individual basis and not in a class or representative action or as a member in a class, consolidated or representative action

7.    Purchase of Electronic Airtime

ntel reserves the right to, without notice, change the method by which you purchase your call credit and access the ntel network. Any services made available to you upon purchase may be varied by ntel from time to time. Furthermore, the charges of such services (if any) may be varied by ntel without notice.

8.    ntel Services

8.1    The network services are made available to you on the basis that you, your employees, agents and sub-contractors:

a.    will not use the services for any improper or unlawful purpose nor allow others to do so.

b.    Will not use the service in any way prohibited by this T&Cs.

c.    will comply with all relevant legislations or regulations relating to use of the terminal equipment and use of network services.

d.    will not act, whether by (commission or omission) in any way likely to injure or damage any person, property or the network or cause the quality of the network services to be impaired or interrupted in any manner.

e.    Will not abuse or threaten any ntel member of staff or agent

8.2    Provision of the network services may be interrupted or suspended by ntel at any time without notice, inter alia:

a.    To facilitate any modifications, maintenance or remedial work in respect of the network services or the network by ntel; or

b.    If your usage of the service is in any way in contravention with 8.1 above or

c.    if you act or omit to act in such a way that the operation of the network or quality of the network service may, in ntel opinion, be jeopardized; or

d.    If the terminal equipment used by infringes or is alleged to infringe the intellectual property rights of any third party.

8.3    ntel shall not be liable for any damage or loss that is a direct or indirect result of your non-compliance with any of these terms and conditions and/or your infringement of the rights of any third party.

8.4    ntel reserves the right to levy a reconnection fee for any reconnection of your terminal equipment that has been interrupted or suspended in the circumstances envisaged in this agreement more particularly for credit services. In such event, ntel reserves the right to refuse to reconnect you unless you furnish security or agree to adhere to payment terms which are acceptable to ntel in the circumstances.

9.    Your Consent to be Contacted

You hereby agree that ntel may contact you without charge, on any wireless telephone number assigned to your account for any purpose, including marketing messages, and in any manner permitted by law. You also expressly consent to be contacted by ntel, and anyone contacting you on ntel’s behalf, for any purpose, including billing, collection, or other account or service related purpose, at any telephone number or physical or electronic address where you may be reached, including any wireless telephone number. You agree that ntel, and anyone contacting you on ntel’s behalf, may communicate with you in any manner, including using a pre-recorded or artificial voice, or using an automatic telephone dialing system to place calls or send messages, alerts, or an automatic e-mail system to deliver email messages. If a contact number you have provided to us is no longer your number, you agree to notify us promptly that you can no longer be reached at that number. You represent that you have received, and are authorised to convey to us, the consent of any authorised users on your account to be contacted by us as described in this Section. You agree that all consents provided in this Section will survive cancellation of your Service and account

10.    Roaming

10.1    Availability and features offered for international roaming and dialing vary depending on your bundle and Device.
10.2    All countries may not be available for roaming yet and available countries may change from time to time.
10.3    Whether roaming internationally or making and sending international calls and messages while in Nigeria you may be charged international rates (including for voicemails left for you and for data usage). This includes per minute rates for calls and per minute rates for calls transferred to your voicemail and the relevant rates for data usage. You may be charged for more than one call for unanswered calls that are forwarded to voicemail regardless of whether the calls result in an actual voicemail message being left for you and regardless of whether your Device is on or off. Different rates and rounding increments apply in different countries. While roaming internationally, your data throughput may be reduced and your Service may be otherwise limited or terminated at any time without notice.
10.4    You are responsible for complying with any export control laws and regulations, and the import laws and regulations of foreign countries when traveling internationally with your Device.

11.    Permitted and Prohibited Uses of ntel’s Service

11.1    Permitted uses include:
11.1.1    Voice calls;
11.1.2    Web browsing;
11.1.3    Messaging;
11.1.4    Email;
11.1.5    Streaming music;
11.1.6    Uploading and downloading applications and content to and from the Internet or third party stores (subject to 11.2.1 below);
11.1.7    Using applications and content without excessively contributing to network congestion; and
11.1.8    Tethering your Device to other non-harmful devices pursuant to the terms and conditions and allotments of your Data Plan
11.1.9    Video streaming
11.2    Prohibited uses include:
11.2.1    Sending, receiving, uploading, downloading or otherwise distributing any material that may be offensive, menacing, or an infringement of copyright or any intellectual property right, a breach of privacy or unlawful.
11.2.2    Using the Services to access content in a way that infringes the rights of others.
11.2.3    Selling, attempting to sell or otherwise provide any commercial service using the ntel Network without first obtaining ntel’s written consent.
11.2.4    Unless explicitly permitted by your bundle you are not permitted to use your Device or the Service in a way which in ntel’s sole discretion is adjudged unlawful, unfair to other users or in contravention of ntel’s Fair Usage Policy whether directly or through a third party, you shall not use any device to route or re-route voice, data or other Services on, from or to the Network, including but not limited to:
11.2.4.1    Using a signal booster or illegal repeaters;
11.2.4.2    Using a GSM Gateway, commonly known as a ‘SIM box’
11.2.4.3    Using a device to forward or divert calls with the intention of reducing your charges for that call
11.2.4.4    Compromising ntel’s network security or capacity, degrades the network’s performance, uses malicious software or “malware”, hinders other customers’ access to the network, or otherwise adversely impacts the network service levels in any way;
11.2.4.5    Using applications which automatically consume unreasonable amounts of available network capacity (See Our Fair Usage Policy here);
11.2.4.6    You hereby expressly accept to abide by ntel’s Fair Usage Policy as may from time to time be published on ntel’s website
11.2.5    Using applications which are designed for unattended use, automatic data feeds, automated machine-to-machine connections, or applications that are used in a way that degrades network capacity or functionality;
11.2.6    Misusing the service, including “spamming” or sending abusive, unsolicited, or other mass automated communications;
11.2.7    Accessing the accounts of other customers without authority;
11.2.8    Tampering with, reprograms, alters, or otherwise modifies your Device to circumvent any of our policies or violate anyone’s intellectual property rights;
11.2.9    Causing harm or adversely affects ntel, the network, our customers, employees, business, or any other person;
11.2.10     Conflicting with the laws of the Federal Republic of Nigeria or with these T&Cs; or
11.2.11    Attempting or assisting or facilitating anyone else in any of the above activities

12.    Additional Terms

12.1    Delay in enforcing ntel’s rights under this agreement shall not constitute a waiver of said rights.
12.2    You cannot assign or transfer the Agreement or any of your rights or duties under this T& C’s without ntel’s written consent. ntel may assign or transfer all or part of its obligations under this T& C’s or your debts to itself, without notice. You understand that the assignment or transfer of all or any part of this Agreement or your debt will not change or relieve you of your obligations under this Agreement.
12.3    You agree to pay all taxes and fees imposed by governments or governmental entities. ntel may not give notice of changes to these charges
12.4    This T&C’s is the entire agreement between you and us regarding the rights you have with respect to your Service, except as provided by law, and you cannot rely on any other documents or statements by any sales agents, distribution partners or other service representatives.
